District court Judge Donald Boone presiding and Charlene Norris prosecuting on behalf of the state.
A charge of possession of marijuana up to one half ounce was dismissed against Justin Christopher Quinn, 19, of 52 Bluff Cove Road, Weaverville, due to compliance with conditions previously set by the court.
A charge of operating a vehicle without insurance was dismissed against John Justin Ratledge, 25, of 1215 Rom Eller Road, Ferguson, due to compliance with conditions previously set by the court.
An order for arrest was issued for Brandy Jo Rawson, 27, of 477 Sugarloaf Road, Boone, for failure to appear on a charge of misdemeanor probation violation. A $2,000 cash bond was issued.
A prayer for judgment continued was granted on a charge of driving after consuming alcohol while underage against Jaspher W. Spurlock, 20, of 1408 Flattop Road, Blowing Rock.
An order for arrest was issued for Keith Allen Tester, 26, of 1925 N.C. 194 South, Todd, for failure to appear on a speeding violation. A $200 cash bond was issued.
A charge of possession of drug paraphernalia was dismissed against Zachary M. Windham, 23, of 166 Grandfather View, Boone, due to compliance with conditions set by the court.
Caleb Austin Young, 19, of 367 N.C. 105 Bypass, Boone, was sentenced to 48 hours in jail on a charge of defrauding a drug screen test.

DWI court with district court Judge Thomas G. Foster Jr. presiding and John W. Alexander prosecuting on behalf of the state.
August A. Beneke, 24, of 188 Hampton Hill Lane, Boone, was found guilty of driving while impaired. A motion to dismiss at the close of state’s evidence was denied. Beneke was sentenced to one year in jail, suspended with seven days active, three years unsupervised probation, and assessed court costs, a $500 fine, and jail fees. Beneke was ordered to complete a 20-hour substance abuse program. A motion to dismiss was granted on charges of exceeding safe speed and driving left of the center line.
March 4
DWI court with district court Judge Thomas G. Foster Jr. presiding and John W. Alexander prosecuting on behalf of the state.
Joshua Matthew Furr, 22, of 4703 Crystal Lake Drive, Greensboro, pleaded guilty to driving while impaired and was found responsible of failure to stop at a stop sign or flashing red light. He was sentenced to six months in jail, suspended with 72 hours active, 36 months unsupervised probation, and assessed a $500 fine and court costs. Motions to suppress evidence and dismiss were allowed in a second driving while impaired charge, and a charge of failure to stop at a steady red light.
Bryan Michael Tarnowski, 22, of 176 Middle Hill Drive, Boone, was found guilty of driving while impaired. He was sentenced to 60 days in jail, suspended, three years unsupervised probation, and assessed $300 in fines and court costs. A charge of impeding the flow of traffic by a slow speed was dismissed.

Adam Mathew Magnussen, 22, of 310 Livingstone Drive, Cary, was found guilty of driving while impaired and driving while license revoked. He was sentenced to one year in jail, suspended with seven days active, three years unsupervised probation, and assessed $546 in fines, court costs and fees. Magnussen was also ordered to complete a 20-hour substance abuse program.
Domestic violence court with district court Judge Bill Leavell presiding and Meredith Roberts prosecuting on behalf of the state.
Jerry Lee Baker III, 20, of 120 Faculty St. Apt. 2, Boone, pleaded not guilty to assault on a female. A motion to dismiss at the close of state’s evidence was allowed.
An order for arrest was issued for David Charles Deiters, 34, of 385 Jenwill Drive, Deep Gap, for failure to appear on a charge of assault on a female. A secured $1,500 bond was set.
An order for arrest was issued for Jimmy Allen Flick, 47, of 140 Flick Drive, Boone, for failure to appear on a charge of assault on a female. A secured $2,000 bond was set.
Charges of assault and battery and injury to personal property were dismissed against Kimberly Arnold Lefevers, 49, of 480 Diamond Ranch Road, Boone, due to witness unavailability.
Charges of unauthorized use of a motor vehicle and misdemeanor larceny were dismissed against Kimberly Dawn Lefevers, 49, of 3005 Bowman Avenue, Morganton, due to witness unavailability.
Charges of communicating threats, harassing phone calls and second degree trespassing were dismissed against Gerry Sedillo, 32, of 139 Laurel Reach Lane, Boone.
A charge of domestic violence protection order violation was dismissed against Michael James Vassil, 45, of 8968 N.C. 105 South, Banner Elk, due to witness unavailability.
William Lonnie Wilson, 46, of 281 Martin Lane, Boone, pleaded guilty to possession of marijuana up to one half ounce. He was assessed court costs and $262.50 in court-appointed attorney fees. A charge of assault on a female was dismissed.
A charge of assault on a female was dismissed against Mark Hardy, age unlisted, of 435 Ransom St., Blowing Rock, due to witness unavailability.
March 7
DWI court with district court Judge Thomas G. Foster Jr. presiding and John W. Alexander prosecuting on behalf of the state.
Michael Lee Foley, 24, of 630 Lois Lane, Banner Elk, pleaded not guilty to driving while impaired. A motion to dismiss at the close of state’s evidence was granted. Foley was found guilty of hit and run with property damage. A prayer for judgment continued was granted and he was assessed court costs.
Emma Walters Lundquist, 59, of 149 Hodges Gap Road, Boone, pleaded guilty to driving while impaired, and a lesser offense of no operator’s license from a charge of driving while license revoked. She was sentenced to one year in jail, suspended with eight days active to be served over four weekends, three years unsupervised probation, and assessed $344 in fines, court costs and fees.
