Aug. 20
Judge Kyle D. Austin presiding and Charlene D. Norris prosecuting on behalf of the state.

Daniel Fitzge Bennett, 21, of 1820 James St., Durham pleaded guilty to possession of drug paraphernalia and possession of marijuana up to one half ounce. Sentencing was consolidated into 120 days in jail, suspended, and two years supervised probation. Bennett was ordered to pay a $500 fine, court costs, $227.50 in court appointed attorney fees, to obtain a substance abuse assessment and comply with recommended treatment. A charge of resisting public officer was dismissed.

Jordan Thomas Coffey, 20, of 124 Chapel Hill Road, Boone pleaded guilty to possession of drug paraphernalia. Coffey was sentenced to 30 days in jail, suspended, one year unsupervised probation and assessed a $100 fine and court costs.

Brett W. Crenshaw, 24, of 1217 Old Bristol Road, Apt. 3, Boone pleaded guilty to simple possession of a schedule VI controlled substance, possession of marijuana up to one half ounce and possession of drug paraphernalia. Sentencing was consolidated into one year supervised probation with compliance and documentation of treatment. Crenshaw was assessed a $200 fine and court costs. Charges of no operators license, registration violation, five counts of possession of stolen goods/property and speeding were dismissed.

Stephanie Davidowski, 21, of 583 Teaberry Hills Road, Boone pleaded guilty to hit and run with property damage. A prayer for judgment continued was granted and Davidowski was assessed court costs. A charge of unsafe movement was dismissed.

An order for arrest was issued for Robert Randall Deluca, 48, of 118 Rocky Lane, Boone for failure to appear on a charge of operating a vehicle without insurance.

Michael Ryan Devol, 26, of 468 Clinton Ave., Kalamazoo, Mich. pleaded guilty to possession of marijuana up to one half ounce. Devol was assessed a $100 fine and court costs.

Matthew Steven Eggers, 19, of 781 Fish Dam Creek Road, Millers Creek pleaded guilty to possession of drug paraphernalia. A prayer for judgment continued was granted.

An order for arrest was issued for Donna Sue Ellis, 47,of 1635 Brooks Shell Road, Elk Park for failure to appear on charges of no operators license and operating a vehicle without insurance.

Matthew Ryan Flowers, 23, of 201 Leighman St., Clemmons pleaded guilty to injury to personal property. A prayer for judgment continued was granted.

Christopher C. Green, 23, of 169 Spring Mountain Road, Charlottesville, Va. pleaded guilty to driving left of center. Green was assessed a $25 fine and court costs. A charge of hit and run with property damage was dismissed.

James Brian Greene, 17, of 123 Nellis Townsend Road, Boone pleaded guilty to simple assault. Greene was sentenced to 30 days in jail, suspended, two years unsupervised probation and assessed $130 in court appointed attorney fees and court costs.

Willis Paul Hicks, 64, of 142 Brown Farm Road, Boone pleaded guilty to possession of marijuana up to one half ounce and driving while license revoked. Sentencing was consolidated into 120 days in jail, suspended, one year supervised probation and assessed a $200 fine, $260 in court appointed attorney fees and court costs. Charges of failure to wear a seatbelt, registration violation and inspection sticker violation were dismissed.

Robert Franklin Kennedy, 18, of 733 Forest Hill Drive, Boone pleaded guilty to second degree trespassing. A prayer for judgment continued was granted.

Brian James Masterson, 22, of 686 Stadium Drive, Boone pleaded guilty to possession of marijuana up to one half ounce and possession of drug paraphernalia. Sentencing was consolidated into 120 days in jail, suspended, two years supervised probation and assessed a $500 fine and court costs. Charges of driving while license revoked and speeding were dismissed.

Salvador Guzman Mina, 30, of 812 Olesprin Lane, Raleigh pleaded guilty to driving while impaired. Mena was sentenced to 30 days in jail, suspended, 12 months unsupervised probation and 24 hours of community service. He was assessed a $100 fine, $273 in court appointed attorney fees, court costs, community service fees and ordered to obtain a substance abuse assessment.

Renee Linda Nelson, 37, of 167 Zeb St., Boone pleaded guilty to disorderly conduct. She was sentenced to 45 days in jail, suspended, two years unsupervised probation and assessed court costs. A charge of communicating threats was dismissed.

Venia Potter Wilson Noguera, 45, of 1552 West King St. Apt. A, Boone was found guilty of assault on a child under the age of 12. She was sentenced to 75 days in jail, suspended, one year supervised probation and assessed court costs and $390 in court appointed attorney fees.

Kevin Bret Nunley, 37, of 154 Ruby Ave., Elizabethton, Tenn. was charged with felony attempted larceny, he pleaded guilty to lesser offense of misdemeanor attempted larceny as well as a charge of no liability insurance. Sentencing was consolidated into 45 days in jail, suspended, two years unsupervised probation, and assessed a $500 fine and court costs. Charges of shoplifting/concealment of goods and two registration violations were dismissed.

Walter Lowe Stiehm II, 21, of 607 Belle Ridge St., North Wilkesboro pleaded guilty to driving while impaired. He was sentenced to 30 days in jail, suspended, 12 months unsupervised probation and 24 hours of community service. Stiehm was assessed a $100 fine, court costs and community service fees, and ordered to complete 20 hours of substance abuse treatment. A charge of improper use of a traffic lane was dismissed.

Terry Wayne Tester, 54, of 1172 Dutch Creek Road, Banner Elk pleaded guilty to injury to real property. Tester was sentenced to 120 days in jail, suspended, one year supervised probation, and assessed court costs and $125 in restitution. A charge of breaking and entering was dismissed.

Robert Wayne Triplett, 42, of 17041 U.S. 421, Deep Gap was found guilty of misdemeanor larceny. He was sentenced to 45 days in jail, suspended, two years unsupervised probation, and assessed a $100 fine and court costs.

Edward Steve Valestin, 24, of 127 Winners Circle, Cary pleaded guilty to hit and run with property damage. A prayer for judgment continued was granted and a charge of reckless driving to endanger was dismissed.

An order for arrest was issued for Trevor Grant Way, 27, of 1130 G. Bridford Lake Circle, Greensboro for failure to appear on charges of driving while impaired and speeding. A secured $500 bond was set.

Erin Ashley Womack, 19, of 1006 Coopers Court, Trent Woods pleaded guilty to possession of marijuana up to one half ounce and drug paraphernalia. Womack was sented to 12 months supervised probation, ordered to obtain a substance assessment, and assessed a $100 fine and court costs.

Charges of unauthorized use of a motor vehicle and breaking and entering against Jacob Landis Davis, 21, of 385 Dogwood Road, Boone were dismissed due to successful mediation.

Matthew V. Delsignore, 21, of 4600 Country Club Road Apt. 111F, Moorehead City pleaded guilty to possession of drug paraphernalia and marijuana up to one half ounce. Sentencing was consolidated into 45 days in jail, suspended, two years unsupervised probation, and assessed a $200 fine and court costs.

A charge of simple assault against Chasity Desorbes, 20, of 581 East King St., Boone was dismissed.

Charges of communicating threats and violation of a protective order against Daniel Jesus Garcia, 25, of 165 Summit Woods Drive Apt. C4, Blowing Rock were dismissed.

An order for arrest was issued for Rodelfo Elias Garcia, 49, of 311 Ridgewood Drive, Boone for failure to appear on a charge of assault against a female. A $2,000 secured bond was set. A charge of violation of a protective order was dismissed due to successful mediation.

William Van Herman, 47, of 543 Laurel Fork Road, Vilas pleaded guilty to exceeding pseudoephederine limits. He was sentenced to 30 days in jail, suspended, two years unsupervised probation. He was ordered to obtain a substance abuse assessment, provide documentation to the court of results and comply with treatment within 60 days. Herman was assessed a $200 fine and court costs.


A charge of violating a protective order was dismissed against Rodney William Jones, 38, of 173 Summer Acres Road, Boone.

Charges of communicating threats and assault and battery were dismissed against Aide Martinez, 24, of 163 Summit Woods Drive Apt. D3, Blowing Rock.

A charge of assault and battery was dismissed against Melissa McDermott, 23, of 659 Charlie Thompson Road, Zionville due to successful mediation.

A charge of assault on a female was dismissed against Nathan Gary Norman, 37, of 271 Norman Road, Boone.

Nine charges of failure to pay sales tax were dismissed against Joseph K. Papa, 58, of 8062 U.S. 321 Bypass, Blowing Rock.

A charge of second degree trespassing, was dismissed against Danielle Nicole Presnell, 19, of 214 Thompson Hollow Road, Vilas.

An order for arrest was issued for Scott Thomas Teubner, 32, of 1930 20th Ave. Drive N.E., Hickory for failure to appear on charges of unauthorized practice of contracting and failure to work after paid. A $10,000 secured bond was set.

An order for arrest was issued for Dirk Allen Webb, 37, of 471 West King St. Apt. 4, Boone for failure to appear on a charge of assault on a female. A $500 secured bond was set.


A charge of assault with a deadly weapon was dismissed against Matthew David Wilkins, 25, of 184 Village Drive, Boone due to successful mediation.
